My proposals are not intended to displace other arguments, such as those who call for a special terrorist court, possible preventive detention mechanisms, military tribunals, and so forth. My proposals are somewhat distinct from those arguments (though obviously related). I, instead, seek to demonstrate how other countries have used their ordinary criminal processes for counterterrorism purposes and how U.S. criminal law can be better attuned to the problem of terrorism. I further seek to demonstrate that issues of terrorist detention do not necessarily require the utter abandonment of our criminal model.
